The forwarder is responsible for the cargo, from the moment of loading until unloading. He is obliged to monitor the loading and unloading of the transported cargo, having previously checked its quality and quantity for compliance with the data specified in the shipper’s documents. The forwarder must organize the route chosen by the client, as well as ensure that the cargo is transported using exactly the vehicle that is necessary for such transportation. Payment of duties, various transport and customs fees and other expenses are also made by the forwarder.

In addition, the responsibilities of the freight forwarder include the preparation of documents that are necessary for import or export, and customs documents, as well as the completion of other formalities associated with cargo transportation. Thus, the forwarder ensures that the cargo is sent and received by the client in full.
When the client transfers the cargo to the forwarder, the forwarder must issue a forwarding document and provide the client with all agreements relating to the carriage of goods. These agreements are concluded on the basis of a power of attorney from the client.
The forwarder has the right to verify the authenticity of the documents provided by the client, the accuracy of information about cargo and other information that may have an impact on the forwarder’s work related to the transportation of cargo sent by the client. The client is obliged to provide all necessary documentation and information to the forwarder on time so that the shipped cargo can pass sanitary, customs and other government controls required by law without delay. The forwarding agreement must immediately indicate which documents the client provided and in what order. This will help prevent some possible problems in the future.
Article 805 of the Civil Code of the Russian Federation states that third parties may be engaged by the freight forwarder to perform forwarding duties if this is provided for in the contract for the carriage of goods. However, the forwarder is responsible for all actions of third parties involved in the transportation of goods, and remains solely responsible to the client for the fulfillment of his duties. The forwarder has no right to conclude a cargo insurance contract on behalf of the client.
In some cases, the freight forwarder may not fulfill any official duties or instructions of the client, if this is done in the interests of the client. This can happen if the client’s instructions turned out to be insufficiently precise or inappropriate, and deviation from the instructions for one reason or another could not be discussed and agreed upon with the client within 24 hours.
The forwarder may delay the release of the transported cargo until he is paid in full the remuneration and all expenses that the forwarder incurred in the process of transporting the cargo are reimbursed. If something happens to the cargo during this time, then no claims can be made against the forwarder, since during this period the client bears all responsibility for the cargo.
The choice of transport and route is within the competence of the client, however, if the client finds it difficult to resolve this issue or refuses to give such instructions, the forwarder himself chooses both the route and the type of transport for transporting the cargo in such a way that the interests of the client are respected.
The agreement between the freight forwarder and the client must stipulate the terms of payment of remuneration to the freight forwarder and compensation for expenses incurred during the transportation of goods.
A transport expedition agreement can be concluded for a period of twelve months. In this case, the contract specifies the general rights and obligations of the parties. For each individual transportation, an annex will have to be drawn up to the contract, which will indicate the characteristics of the goods, the route and terms of transportation.
